To inform ZA of recent development concerning Human Use issue.
MEMORANDUM FOR RECORD. (Describe briefly the requirement, background and action taken or recommended. Must be sufficiently detailed to identify

1. (S) BACKGROUND: In April 1979, Army General Counsel determined that Army could
proceed/continue GRILL FLAME activities as long as HEW guidelines and other precaution-
ary measures outlined in Army General Counsel letter dated 15 Feb 79 were met.
2. (S) DISCUSSION: To date all guidelines as described by Army General Counsel have
been followed. On 22 Oct 80 at the request of DIA General Counsel, OSD, DIA, and Army
General Counsels met to discuss the Human Use Issues with regard to GRILL FLAME
activities. This meeting resulted in a jointly agreed decision by the General Counsels
that it would be prudent to obtain written approval from the Deputy Secretary of
Defense as GRILL FLAME activities probably do constitute human experimentation. All
General Counsels appeared to agree that this would not result in anything more than an
administrative procedure, and should not have an adverse impact on the GRILL FLAME
program. Until written approval is received, we are not required to stop our GRILL
FLAME activities. ZC was informed of the above information on 23 Oct 80.
3. (U) IMPACT: None at this -time.
4. (U) ACTION REQUIRED: MAJ Hay will continue to monitor situation and keep ZA and
ZC informed.
5. (U) RECOMMENDATION: ZA take' note.
